82174 (2024). Dr Tracey McLellan to the Minister of Corrections: What accountability measures are in place to address concerns regarding inappropriate use of force and pepper spray in the Persons of Extreme Risk Unit (PERU), as highlighted in the Ombudsman’s report?

Hon Mark Mitchell: I am advised that use of force is only considered when all other reasonable alternatives have been attempted or, in extreme circumstances, when all other reasonable alternatives are considered inappropriate due to the nature of the situation. It is discontinued at the first safe opportunity once control is regained. I am further advised that all instances of use-of-force in the Persons of Extreme Risk Unit (PERU) are reviewed by Auckland Prison management and should use-of-force not be considered proportionate, action would be taken to ensure that this does not reoccur through additional training and performance discussions with staff.
