80884 (2024). Francisco Hernandez to the Minister for Regulation: Why was a Regulatory Impact Statement exemption made for 'one part of the work relating to the Regulatory Standards Bill', when the Minister took a paper on this bill to Cabinet?

Hon David Seymour: The Regulatory Standards Bill received a partial exemption for impact analysis requirements because part of the proposal dealt with changes to the internal administration of government and had no impacts on businesses, individuals or not-for-profits. The partial exemption was for elements of the proposal which created a statutory framework to give effect to the Ministry for Regulation’s regulatory oversight role in undertaking regulatory reviews. It included powers for myself to initiate a regulatory review and set the Terms of Reference, and obligations relating to tabling and publishing the final review report and government response. Proposals of this nature are eligible for an exemption under paragraph 24 of the Cabinet Office Circular on impact analysis requirements (CO (20) 2). The Ministry for Regulation considered and applied the exemption grounds to this proposal in the same way that it does for all Cabinet papers considered under the Regulatory Impact Analysis circular.
