Hon Brooke van Velden: The examples cited in my personal grievance press release on 4 December 2024 are publicly available Employment Relations Authority and Employment Court determinations, as referenced below: • In 2021 an employee who was dismissed for falsifying information on their timesheet still received $10,500 in compensation and 13 weeks of lost wages from their former employer. Wirihana v AML Ltd [2021] NZERA 14 • In 2012 a health professional was dismissed for being physically violent toward a patient yet was still reinstated into their role following a successful personal grievance. De Bruin v Canterbury District Heath Board [2012] NZEmpC 110 • In 2022 an employee who was dismissed for theft of company food still received $21,000 in compensation from their former employer. Maheno v Carrington Resort Jade LP [2022] NZERA 635.
