78576 (2024). Hon Jan Tinetti to the Minister of Internal Affairs: Further to her answer to written question 75409 (2024): Did the Minister request advice on requiring overseas operators be required to have New Zealand based staff, if not, why not?
Hon Brooke van Velden: I did not request advice from the Department of Internal Affairs on this specific matter. My understanding is that the presence of staff in New Zealand makes no difference to the ability to take enforcement action. There will be an explicit provision in the legislation requiring a local address for service that applies to all licence holders even if they are based offshore. The Department of Internal Affairs can monitor licence holders digitally to ensure compliance with the regulatory system.
An address for service will simplify the process for serving papers to bring court proceedings against a licence holder.
