76651 (2024). Hon Dr Duncan Webb to the Minister of Justice: How many new warrantless search powers, if any, have been proposed or introduced by the current Government
Hon Paul Goldsmith: One new warrantless search power has been introduced by the current Government within the Justice portfolio. This is in the Firearms Prohibition Orders Legislation Amendment Act 2024 (FPO Act). The FPO Act inserted new section 18AA into the Search and Surveillance Act 2012. Section 18AA provides a new warrantless search power for Police to monitor whether a person with a Firearms Prohibition Order is complying with the conditions of the order. The purpose of the search must be to monitor compliance with an FPO, not to locate evidence of offending (s18AA(1)).
