62498 (2024). Camilla Belich to the Minister for Workplace Relations and Safety: What feedback was suggested by unions and then incorporated into the Minister's policy as stated in response to a supplementary question to oral question 6 on 17 September 2024?
Hon Brooke van Velden: The coalition Government’s proposed gateway test includes a requirement that hiring businesses give the worker a reasonable opportunity to seek advice on the written agreement. This is consistent with feedback from unions that someone who enters an agreement where they are labelled a contractor should have a sufficient opportunity to seek advice and understand the nature of the agreement.
The CTU considered that additional limbs should be added to the test to ensure only genuine contracting relationships could meet the test, including whether the work could be sub-contracted. The coalition Government’s proposed gateway test includes sub-contracting as part of its criteria.
