62254 (2024). Hon Dr Duncan Webb to the Minister for Courts: Further to WPQ 57903 (2024), in the "first principles review of that Act to identify a modern, fit-for-purpose regime that enables increased use of remote participation in court, enhances access to justice and promotes efficiency, without compromising the interests of justice" will victims always be able to attend in person, with the offender/accused in person at trials and sentencing if they choose to - or would the minister consider proposals excluding victims from the right to be present in person?
Hon Nicole McKee: The Courts (Remote Participation) Amendment Act 2024 recently enacted a presumption that victims may observe a criminal trial and sentencing remotely if the victim wishes to do so, suitable technology is available, and a judicial officer or court registrar considers this to be appropriate. This will come into effect on 2 March 2025.
Any changes arising from the first principles review of the Act are yet to be determined. Options for change, however, will balance a range of important considerations, including open justice, fair and just processes, including for victims, and efficiency.
