59614 (2024). Ricardo Menéndez March to the Associate Minister of Immigration: Does the Minister have a policy or position on requests for special direction where the request is made within the 42-day window to file an appeal through the Immigration and Protection Tribunal, and if so, what is that policy or position?
Hon Chris Penk: It is not my usual practice to consider requests for intervention in individual cases where avenues are available with the Immigration and Protection Tribunal (IPT). The IPT is an independent body established under the Immigration Act 2009 to consider appeals, including appeals against residence decisions. A client can appeal a residence decision if they believe the decision was incorrect, or that they have special circumstances that warrant the Minister’s consideration of an exception to immigration instructions. It provides a comprehensive and robust process for challenging an immigration decision.
