Camilla Belich to the Minister of Commerce and Consumer Affairs: How many Non-Disclosure Agreements, if any, have been entered into with employees, former employees, contractors, or consultants in each of the entities for which the Minister is responsible since 27 November 2023, broken down by month?
Hon Scott Simpson: I am advised the numbers of Non-Disclosure Agreements are as follows. • Accreditation Council: o 2025: <5 • Commerce Commission: Nil • External Reporting Board (XRB): o 2024: <5 • Financial Markets Authority (FMA): Nil. All staff and contractors are subject to confidentiality obligations under their Individual Employment Agreements (or contracts for service as the case may be). These obligations are required in order to support the FMA’s statutory obligation of confidence under section 59 of the Financial Markets Authority Act 2011. • Retirement Commission: One Non-Disclosure Agreement has been used to engage a group of teachers/consultants for feedback on a financial education project that was not yet public. • Takeovers Panel: Nil *To protect the privacy of persons involved, the totals have been done by quarter, and any number of people less than 5, has been given <5.
