Camilla Belich to the Minister for Economic Growth: For what reasons, if any, have Non-Disclosure Agreements been used in each of the entities for which the Minister is responsible since 27 November 2023, broken down by category of issue (such as conduct, grievances, employment disputes, whistleblowing, or other)?

Hon Nicola Willis: I am advised the entities I am responsible for do not use Non-Disclosure Agreements in resolving employment relations matters. However, in line with section 149 of the Employment Relations Act 2000, MBIE does enter into Confidential Records of Settlement, of which there were 72 in the period requested. I am advised that providing the Member with this information would require the entities I am responsible for to undertake a substantial collation exercise due to the quantity of data requested which would take staff away from core duties. As such I consider that the time, and hence the expense, of answering that part of the Member’s questions is not in the public interest.
