56212 (2025). Camilla Belich to the Minister for Trade and Investment: For what reasons, if any, have Non-Disclosure Agreements been used in each of the entities for which the Minister is responsible since 27 November 2023, broken down by category of issue (such as conduct, grievances, employment disputes, whistleblowing, or other)?
Hon Todd McClay: For New Zealand Trade and Enterprise, I am advised none. However, confidentiality clauses are included as a standard practice in any settlement agreement. For Invest NZ, I am advised non-disclosure agreements are routinely entered into between Invest NZ and third parties where the parties are undertaking feasibility studies, research, early-stage projects or other commercial ventures where commercially sensitive information needs to be shared and protected.
