56122 (2025). Camilla Belich to the Minister for Social Development and Employment: For what reasons, if any, have Non-Disclosure Agreements been used in each of the entities for which the Minister is responsible since 27 November 2023, broken down by category of issue (such as conduct, grievances, employment disputes, whistleblowing, or other)?
Hon Louise Upston: I am advised by the Ministry of Social Development (the Ministry) that the Ministry does not use non-disclosure agreements in the resolution of employment disputes. When matters are resolved and recorded in a Record of Settlement under section 149 of the Employment Relations Act 2000, the Ministry includes a standard clause relating to confidentiality. This is to protect both parties in terms of the details of any settlement.
