Camilla Belich to the Minister for Infrastructure: For what reasons, if any, have Non-Disclosure Agreements been used in each of the entities for which the Minister is responsible since 27 November 2023, broken down by category of issue (such as conduct, grievances, employment disputes, whistleblowing, or other)?

Hon Chris Bishop: National Infrastructure Funding and Financing (NIFFCo): No Non-Disclosure Agreements issued during this period. Crown Infrastructure Delivery (CID): I am advised that CID used two Non-Disclosure Agreements in this period covering two Treasury officials and their access to confidential CID material. CID also uses standard confidentiality clauses in employment related settlement agreements and in property and project related agreements but CID does not consider these to be Non-Disclosure Agreements. Infrastructure Commission: I am advised that the Commission has adopted the government’s Protective Security Requirements and expects all employees and contractors to abide by these regarding the handling of sensitive information. There are no specific Non-Disclosure Agreements in place beyond these general requirements. From time to time their employees and contractors are also required to sign non-disclosure agreements relating to information produced or processes led by other agencies (for example, confidentiality undertakings required by Treasury for the purposes of allowing access to information relating to quarterly investment reporting, Budget processes, and Gateway reports, or non-disclosure agreements required by MBIE in participation for all-of-government panel contracts).
