Hon Dr Duncan Webb to the Minister of Transport: What steps is the Minister or Ministry taking to ensure that persons who collect personal information under the provisions of sections 236 or 241 of the Land Transport Act 1988 comply with Privacy Principle 3A once the Privacy Amendment Act 2025 comes into force?

Hon Chris Bishop: The Ministry’s Privacy Officer will lead work to ensure the Ministry complies with Privacy Principle 3A when it comes into force on 1 May 2026. This work will include reviewing and implementing any guidance issued by the Office of the Privacy Commissioner and reviewing and updating Ministry policies and guidelines. I note that section 236 of the Land Transport Act 1998 applies to the Registrar of Motor Vehicles which is a function of the New Zealand Transport Agency. I also note that section 241 allows the Secretary for Transport to authorise persons or a class of persons to have access to certain information. Any decision made under section 241 will be informed by the Privacy Principles when or if decisions are made under that section.
