43997 (2025). Ricardo Menéndez March to the Minister of Immigration: How many people, if any, are expected to be subjected to deportation liability as a result of "expanding deportation liability for up to 20 years to cover residence class visa holders who commit serious criminal offences"?
Hon Erica Stanford: The Ministry of Business, Innovation and Employment has estimated a potential increase of up to 30% in both people being liable for deportation under section 161 of the Immigration Act 2009 and actual deportations based on the changes to deportation liability I intend to bring to the House in the next immigration bill. The Bill will go through the usual legislative process, including Select Committee scrutiny. There are two main limitations with this estimate, the first is that it has not been widely tested and secondly, there are data sharing constraints related to criminal offending. Where deportation liability is activated people continue to retain their rights to appeal to the IPT.
