43913 (2024). Hon Dr Ayesha Verrall to the Associate Minister of Health: What progress, if any, has been made in the quarter January to March 2024 on the action ‘Support planned work by MSD and the Law Commission to review statutory mechanisms for decision making and consent with a view to shifting toward a supported decision-making model, with appropriate partnerships to explicitly identify and address the equity issues that arise for Māori whānau’ under the objective ‘Build accepting and understanding communities’ within Te Whatu Ora’s Improving Dementia Mate Wareware Services in Aotearoa New Zealand Action Plan?
Hon Casey Costello: I am advised that the Law Commission is undertaking a Review of Adult Decision-Making Capacity Law. A second issues paper was published in April 2024, with consultation closing on 21 June 2024. Feedback received will inform recommendations made in a final report, which is due to the Minister of Justice in 2025. The Review includes consideration of supported decision-making models, equity issues for Māori and how to better reflect Te Tiriti o Waitangi in the legal framework
