37344 (2026). Camilla Belich to the Minister of Justice: What are the terms of reference for the investigation being conducted by Kristy McDonald KC into concerns about Dr Stephen Rainbow's conduct as Chief Human Rights Commissioner?

Hon Paul Goldsmith: The terms of reference require that the investigator: • Will investigate the concerns raised by the other Commissioners; • Will report to the Minister of Justice on any findings about whether those concerns are established; • Will advise the Minister whether, in the investigator’s opinion, there is just cause for the Minister, if he wishes, to advise the Governor-General to remove Dr Rainbow from office as Chief Commissioner; and • May report to the Minister on any other matters about the HRC that the investigator considers appropriate as being relevant to the purposes of the investigation or relevant to the Minister in his role as responsible Minister.
