37099 (2025). Francisco Hernandez to the Minister for the Public Service: How many public service commissioners since 2010, if any, have taken an active role in collective bargaining across the public sector?
Hon Judith Collins: I am advised that the role of the Public Service Commissioner in public sector bargaining varies depending on the type of organisation and the applicable legislative context.
Within the Public Service, the responsibility for collective agreement bargaining sits with the Public Service Commissioner, but it has been the usual practice since 2010 for Commissioners to delegate responsibility for bargaining to the relevant chief executive. However, they tend to remain actively involved through the conditions of delegation that require engagement with the Public Service Commissioner and through the general support and assistance that is provided to agencies in bargaining by the Public Service Commission’s employment relations team.
