Hon Priyanca Radhakrishnan to the Prime Minister: Does the Chair of the Terrorist Designation Working Group need his permission to gazette the notice of the decision to allow the designation of the American Proud Boys as a terrorist entity to lapse before doing so, if so, how is that documented?

Rt Hon Christopher Luxon: Under section 29B of the Terrorism Suppression Act 2002, a designation automatically expires 3 years after the date on which it takes effect unless it is either revoked or renewed. Under section 29D, if a designation expires, in my capacity as Prime Minister I must ensure notice of the expiry is published in the Gazette as soon as practicable.
