34444 (2026). Tangi Utikere to the Minister of Transport: What mechanisms, if any, allow the Crown Capital Contribution for Warkworth to Te Hana to be recovered if the project is not completed or if construction defects are later identified?

Hon Chris Bishop: The Crown Capital Contribution is excluded from any compensation payment made to the Contractor on termination of the Project (so, in effect, the value remains with the Crown on termination). There is a defects rectification regime in the Project Agreement but this is not linked to the Crown Capital Contribution.
