32664 (2025). Hon Jan Tinetti to the Minister for Workplace Relations and Safety: Does the gateway test consider flexible work hours as evidence that someone is a contractor?

Hon Brooke van Velden: The gateway test in the Employment Relations Amendment Bill requires several criteria to be met for a person to be a ""specified contractor"". The test has been designed to reflect genuine contracting relationships, of which a person's ability to work at times they choose is one criterion.
