32629 (2025). Arena Williams to the Minister of Commerce and Consumer Affairs: Did MBIE's draft clause to exclude active litigation in the Credit Contracts and Consumer Finance Amendment Bill specifically refer to ANZ or ASB?

Hon Scott Simpson: MBIE did not draft a clause excluding active litigation from the retrospective amendment in the Bill. MBIE prepared an alternative recommendation for me to table at a meeting of the Cabinet Legislation Committee in the event the Committee did not accept my proposal for the amendment to apply to active litigation, and instead preferred Option 2 from MBIE's Regulatory Impact Statement.
