30876 (2025). Celia Wade-Brown to the Minister for Workplace Relations and Safety: Was the Minister aware of the advice from Herenga ā Nuku Aotearoa, the Outdoor Access Commission regarding landowner responsibility on private land when drafting her Worksafe amendments to health and safety responsibilities for landowners, particularly concerning recreational activities on private and public land?
Hon Brooke van Velden: Officials considered the Outdoor Access Commission's submission to the public consultation I undertook last year on reforming work health and safety. The Commission recommended amending the Health and Safety at Work Act 2015 (the HSW Act) to more clearly state that landowners do not have liability for recreational visitors on land for risks unrelated to the landowner’s work. Their submission informed officials' advice to me on my amendment to the HSW Act to free up recreational access.
