28426 (2026). Francisco Hernandez to the Minister for Social Development and Employment: What policies, if any, are in place regarding the docking or cancelling of New Zealand superannuation if recipients fail to show proof that they are not eligible for pensions overseas?

Hon Louise Upston: I am advised that under the Social Security Act 2018, benefits payable under the New Zealand benefits legislation, including New Zealand Superannuation (NZS), are reduced by the person’s overseas pension. People who apply for NZS and other benefits are required to take reasonable steps to obtain the overseas pension they, or their dependent, may be entitled to. The applicant’s spouse or partner is also required to take reasonable steps to obtain their overseas pension entitlement. The Ministry of Social Development (the Ministry) may notify the applicant or a recipient of NZS and/or other benefits to take reasonable steps to obtain the overseas pension they, or their dependant, may be entitled to. The Ministry may also notify the applicant or the recipient’s spouse or partner. If the person fails to comply with the Ministry’s notice, their application for NZS or another benefit may be refused, or if they or their spouse or partner receives NZS and/or other benefits, then their payments may be suspended or cancelled. Applicants and clients are required to test their entitlement to any overseas pension to ensure that they receive their correct NZS and other New Zealand benefit entitlements.
