28353 (2025). Camilla Belich to the Minister for ACC: How many claimants, if any, were previously declined ACC compensation prior to the Accident Compensation Corporation v TN [2023] NZ Court of Appeal judgement, and what measures are in place to reassess these cases?

Hon Scott Simpson: ACC advises me that it is unable to determine how many claimants may have been declined ACC weekly compensation for the loss of earnings capacity prior to the Accident Compensation Corporation v TN [2023] NZ Court of Appeal judgment. It is not possible for ACC to filter claims data with the level of specificity that is required to determine this figure. ACC further advises me it contacted relevant professional bodies when the TN Court of Appeal ruling was announced to inform them of the judgment. Professional bodies could then circulate the information to members, providers and individual clients. Additionally, ACC’s final implementation plan for this judgement includes a communication plan for providers, professional bodies and the public.
