28152 (2025). Debbie Ngarewa-Packer to the Minister of Transport: What Treaty of Waitangi obligations or internal consultations protocols, if any, does Waka Kotahi follow when proposed roading changes may impact culturally significant Māori sites?

Hon Chris Bishop: I am advised that NZ Transport Agency Waka Kotahi (NZTA) must engage meaningfully with Māori when planning projects that could affect culturally significant sites. This includes ensuring feedback from Māori are part of transport decision-making processes. Legally, NZTA must comply with sections 5(2), 6(e), 6(f), 7(a) and 8 of the Resource Management Act 1991 (the Act). To complement the Act’s requirements, NZTA has the following internal frameworks: • Te Ara Kotahi – Our Māori Strategy (2020) – guides how NZTA works with and respond to Māori as the Crown’s Treaty partner • Z/19 Taumata Taiao – Environmental and Sustainability Standard (2022) – includes policies on cultural heritage • Hononga ki te iwi – NZTA’s Māori engagement framework • Toitū Te Whenua - Māori Land Guidance – guides how NZTA deals with Māori land matters.
