Hon Willow-Jean Prime to the Lead Coordination Minister for the Government's Response to the Royal Commission’s Report into Historical Abuse in State Care and in the Care of Faith-based Institutions: Why are legal fees or legal aid not available for survivors of abuse in care applying for a top-up payment?

Hon Erica Stanford: Most top-up payments for closed claims will be made on an ex-gratia basis and will not affect any clauses contained in a survivor's final settlement agreement. There are some exceptions to this where support to access legal advice will continue to be offered.
