Ricardo Menéndez March to the Minister of Immigration: Further to Written Question 6242 (2026), Since 01 January 2015, how many people, if any, were detained by Immigration Compliance Officers relying on section 328 of the Immigration Act 2009 due to a belief that a person was “fleeing,” broken down by visa type, nationality, ethnicity, gender, and age?

Hon Erica Stanford: I am advised the section of the Act referred to under s328 - is used when Clients are taken into custody and meet the provisions of the Act/Legislation. I am further advised that available records of Compliance use s328 shows a total of 23 records since 1 January 2020 for 20 individuals. Older data is not available due to system constraints. I refer the Member to the attached document for information relating to these individuals.
