18189 (2026). Arena Williams to the Minister for Building and Construction: Why will the proposed exemption to include Structural Insulated Panels with a CodeMark certificate be progressed by Order in Council rather than through the usual full legislative process; and how, if at all, can the public contribute their feedback on this proposal?
Hon Chris Penk: The Building Act states that the Governor-General may, by Order in Council, on the recommendation of the Minister, amend Schedule 1A by adding to, removing, or amending any requirements for a small stand-alone dwelling. This is a straightforward technical change that makes interpreting Schedule 1A clearer, while supporting homes that are constructed under the exemption to meet the building code. Targeted engagement was undertaken with affected stakeholders as it is a technical change to regulations.
