Hon Chris Penk: Marketing activities undertaken by businesses are subject to the Fair Trading Act 1986. The Act includes provisions relating to misleading and deceptive conduct, as well as unsubstantiated representations. Several pathways exist should a person be concerned with the marketing activities of a business, including raising the concern with the business in question, or making a complaint to the Commerce Commission.
