Chlöe Swarbrick to the Minister of Health: Why has the Minister not reviewed the levels and methods of cost recovery in relation to any class of psychoactive substance or approved products, persons, or other matter since the commencement of the Psychoactive Substances Act 2013, given that a three-yearly review is a requirement of Section 94 of the Act?

Hon Dr Ayesha Verrall: A review of the cost recovery model for activities occurring under the Psychoactive Substances Act 2013 (the Act) has not been yet been warranted due to the very low level of activity occurring since the Psychoactive Substances Amendment Act 2014 (the Amendment). The Amendment removed the ability of the Psychoactive Substances Expert Advisory Committee (the Committee) to give regard to the results of animal testing when considering whether a psychoactive product should be approved for use. As a result, I am advised that very few applications have been received by the Committee and no products approved.
