13744 (2026). Scott Willis to the Minister of Commerce and Consumer Affairs: Is the Commerce Commission or the Minister actively considering any enforcement measures against fuel companies if evidence of excessive margins occurs, if not, why not?
Cameron Brewer: I am advised by the Commission that, where it identifies any pricing that is outside the expected distribution, it will raise this with fuel companies and call out any behaviour of concern publicly. The Commission has not yet publicly called out any behaviour of concern. The Commission will intervene if it appears that a business’s pricing behaviour is likely to have misled consumers or appears to have breached other provisions of the Fair Trading Act 1986. Investigations under the Fair Trading Act are confidential.
