10321 (2024). Hon Kieran McAnulty to the Minister of Local Government: Will the Crown be liable for Watercare’s loans under the Local Water Done Well model, and if not, why not?
Hon Simeon Brown: No. The Local Government Act 2002 currently provides that the Crown is not liable for debts of any local authority, and that loans entered into by local authorities must include disclosures they are not guaranteed by the Crown. These legislative settings will be extended to Watercare so that any loan contracts entered into by Watercare must include disclosures they are not guaranteed by the Crown.
