8913 (2024). Hon Dr Duncan Webb to the Associate Minister of Finance: Does EQC / Toka Tū Ake have a policy as to how to resolve a claim where homeowners have made claim of negligent scoping of damage and/or negligent repairs in respect of damage caused in the Canterbury Earthquake Sequence in respect of damage which is over the cap amount?
Hon David Seymour: I am advised that the Earthquake Commission Toka Tū Ake has no general policy on how to consider allegations of negligent scoping of damage and/or negligent repairs. I am advised that where the Earthquake Commission Toka Tū Ake faces potential negligence claims in relation to alleged defective work and/or missed damage, the Earthquake Commission Toka Tū Ake will always consider whether settlement is appropriate as opposed to litigation. When doing so, the Earthquake Commission Toka Tū Ake will closely consider the claim made by the homeowner.
