8585 (2025). Ricardo Menéndez March to the Associate Minister of Immigration: What is the policy rationale, if any, behind the minister's practice of not considering requests for ministerial intervention if an individual has previously made such a request that was declined within the past 18 months?
Hon Chris Penk: Prior to March 2023 the parameters letter set out that the Associate Minister did not generally wish to consider cases where the individual has made a request for ministerial intervention which has been declined in the past 12 months. In March 2023 this was increased to 18 months because increasingly new representations were being made shortly after the 12-month period expired. My expectation is that immediately following a declined request for ministerial intervention the client works with INZ to arrange a voluntary departure to avoid deportation action.
