8554 (2025). Dr Lawrence Xu-Nan to the Associate Minister of Education: How, if at all, is it being determined whether the food safety concerns with the School Lunch Collective's (SLC) meals has amounted to a material breach of the contract between the Ministry of Education and the SLC?
Hon David Seymour: The Ministry is actively monitoring agreed service levels with the SLC during the implementation and early roll out of the programme. If, after a formal review process, a material breach of contract is identified, a written notice would be sent. The Ministry has set high expectations for the SLC. The Services Agreement with the SLC includes provisions for monitoring the supplier's performance against agreed service levels. The Ministry is actively monitoring these agreed service levels during the implementation , and will be undertaking formal reviews to measure performance against key metrics. New Zealand Food Safety is undertaking its investigation.
