6876 (2025). Francisco Hernandez to the Minister of Police: What New Zealanders' data, if any, is shared by the Minister's department, if any, with any US government department?

Hon Mark Mitchell: I am advised that Police can share a New Zealander’s biographic and biometric information with USA law enforcement, under sections 95B and 95C of the Policing Act 2008; and within the guidelines of international organisations of which New Zealand is a member (e.g. via the INTERPOL network for criminal investigation related matters). The extent and nature of that sharing will depend on what is allowed under those various mechanisms. Please note that biographical data is personal information about the person e.g. full name, date of birth addresses, phone numbers, criminal history. Biometric data is information about a person’s unique physical or behavioural characteristics. The most common shared being fingerprints and DNA profiles. In regard to the Serious Fraud Office (SFO), The SFO does not have any current information sharing agreements with any US government departments. It is not in the public interest for details about specific operational matters to be disclosed.
