6740 (2025). Francisco Hernandez to the Minister for Children: What protections, if any, exist in the Minister's department, if any, to prevent New Zealanders' information shared with US government departments, if any, being shared with third parties?
Hon Karen Chhour: I am advised by Oranga Tamariki that when sharing information with a government department from another country such as the United States, they are reliant on the overseas country’s privacy legislation and settings, as well as any contractual requirements that they have placed on the overseas government organisation. This includes further sharing of the information by the government department. I am further advised Oranga Tamariki applies Principle 12 – ‘Disclosure outside New Zealand’ of the Privacy Act as the basis for disclosing personal information to overseas government departments.
