Hon David Seymour: Acting appointments can be made by the Commissioner or Deputy Commissioner without the need to consult with the responsible Minister. There is no appointment process defined for acting chief executives in the Public Service Act (unlike for substantive appointments, where the touch points for Ministers are clearly set out). The relevant provision of the Act that applied to the acting Secretary for Regulation is section 9(4) relates to the establishment of new agency, and says: If a new department or departmental agency or a functional chief executive role is to be established on a certain date, the Commissioner may appoint a person to act in the role whom the Commissioner thinks suitable to perform the functions and duties and exercise the powers of the chief executive of that new department or departmental agency or the functional chief executive role.
