3216 (2026). Hon Jan Tinetti to the Minister for Workplace Relations and Safety: What criteria, if any, has WorkSafe been directed or encouraged to use when “actively consider[ing] other enforcement options before recommending prosecution”?

Hon Brooke van Velden: I am advised that WorkSafe New Zealand is required to follow the Solicitor-General’s Prosecution Guidelines and will apply its relevant policies and processes when considering alternatives to prosecution.
