3210 (2026). Hon Jan Tinetti to the Minister for Workplace Relations and Safety: What changes have been made to WorkSafe’s enforcement decision‑making framework to “improve the consistency of its enforcement decisions” as referenced in the Letter of Expectations of May 2025?
Hon Brooke van Velden: I am advised that WorkSafe New Zealand is implementing recommendations from its September 2025 review of its enforcement decision-making model (EDM) over three phases. Phase one ensured the EDM is consistent with WorkSafe’s strategy, regulatory approach and prosecution policies, and with the Solicitor-General's Prosecution Guidelines (including consideration of alternatives to prosecution), which came into effect on 1 January 2025. Subsequent updates to EDM are planned for 2026 and will provide further assurance that WorkSafe’s enforcement decision making framework is fit for purpose in supporting consistent, proportionate, and transparent enforcement decisions.
