2767 (2024). Tangi Utikere to the Minister of Transport: What specific statutory functions, if any, have been exercised and reported to the Minister by the following since 27 November 2023: Director of Land Transport (Waka Kotahi); Director of Civil Aviation (Civil Aviation Auhtority); Director of Maritime New Zealand (Maritime New Zealand)?

Hon Simeon Brown: The statutory functions for the Director of Civil Aviation are set out in section 72I of the Civil Aviation Act 1990. The Authority does not generally report on the specific exercise of these functions to the me. This is because the Director must act independently and must not be responsible to the Minister for the performance or exercise of such functions. Statistics relating to the exercise of statutory functions are set out in the Authority’s Annual Reports, published online at https://www.aviation.govt.nz/about-us/corporate-publications/#Annual-reports. The Authority may advise me of a specific decision on a ‘no surprises’ basis if there is a need to. NZTA has a wide range of statutory functions in its role as regulator. This includes those which sit with the Director of Land Transport, who has reported the following statutory functions to me since 27 November 2023: - 80kph for SH25A in the Coromandel - 80kph on new interchanges and ramps on SH1, Constellation Drive - 80kph on Old SH1 Popular Ave to Raumati Road - 80kph on Old SH1 Raumati Road to Ihakara Street - a batch of speed limit changes in Northland and north Auckland in townships and around schools where there was community support. I delegated responsibility for Maritime NZ on 19 January 2024 to the Associate Minister of Transport. Maritime NZ exercises a wide range of statutory functions in its day to day role as regulator under the Maritime Transport Act 1994, Health and Safety at Work Act 2015, Maritime Security Act 2004, Ship Registration Act 1992, Submarine Cables and Pipelines Protection Act 1996, Hazardous Substances and New Organisms Act 1996 and Civil Aviation Act 1990 (search and rescue under Section 14(c)). Maritime New Zealand regularly reports to its Minister on critical matters, informing them of significant prosecutions and of major search and rescue activities but does not generally report on the specific exercise of its statutory functions as the Director must act independently and must not be responsible to the Minister for the performance or exercise of such functions.
