2103 (2026). Tamatha Paul to the Minister of Police: What is the ratio for charges versus warnings relating to trespass notices between September 2024 – September 2025 broken down by ethnicity?
Hon Mark Mitchell: I refer the Member to the attached table, which shows the ethnicity of people who have been proceeded against for offences classified under the Australian and New Zealand Standard Offence Classification (ANZSOC) Group – ‘1221 Trespass’, broken down by the percentage of proceedings that resulted in a charge and the percentage that resulted in a warning, for each ethnicity, between 1 September 2024 and 30 September 2025.
Trespass notices are typically issued by the individual or organisation that is the occupier of the property in question, either formally (in writing) or verbally. In some circumstances, Police may become involved in issuing a trespass notice – for example, where the occupiers fear the person(s) on whom they wish to serve notice, or where large crowds are involved. A person can only be charged or receive a warning in relation to trespass offences, rather than the issuing of a trespass notice itself.
I am advised that there are limitations to ethnicity recording. Only one ethnicity can be recorded per individual, and if a person identifies with an ethnicity that is not listed, their ethnicity is recorded as ‘Other’. An individual may commit multiple offences during this period and will be counted once for each offence they were proceeded against for.
