Hon Priyanca Radhakrishnan to the Prime Minister: Is the Chief Executive of the Department of Prime Minister and Cabinet correct that the January 6 2021 United States Capitol attack was not “picked up in the statement of case and wasn’t considered” in the 2025 statement of case on the re-designation of the American Proud Boys as a terrorist entity under the Terrorism Suppression Act 2002?

Rt Hon Christopher Luxon: I am advised that the 6 January 2021 Capitol Attack was referenced twice in the 2025 statement of case, however, this event was not part of the assessment of the designation of the American Proud Boys as a terrorist entity under the provisions of the Terrorism Suppression Act 2002. I am advised a recommendation to renew a designation requires evidence from within the 3-year period since the last time that entity was designated to indicate that the entity continues to pose a risk of carrying out, or participating in carrying out, terrorist acts.
